Welcome to SmartestHR, the recruitment platform for job seekers and employers. By using the SmartestHR platform you agree to be bound by these Terms of Use. If you do not agree with these Terms of Use, please do not use this platform.

SmartestHR platform is owned and operated by SmartestHR, kadrovsko in poslovno svetovanje, d.o.o., Rožna dolina, cesta IX 43, 1000 Ljubljana, Slovenia, registration number 8354154000, registered with the District Court of Ljubljana, with the share capital of EUR 23,002.00 (the “SmartestHR”).

1. How the SmartestHR service works

You need to register in order to use the SmartestHR platform services. The SmartestHR platform may be used only by persons 18 years of age or older.

The proper provision of our services requires us to collect and use certain information about you. Job seekers undertake to submit accurate and true data about themselves when applying to jobs and are liable for their accuracy and credibility. SmartestHR disclaims any liability for false data submitted by job seekers.

SmartestHR undertakes to submit your application to potential employers only if we feel, in our sole discretion, that your professional experience and your personal profile are judged to be a good fit and you have genuine interest in this opportunity. Your information will be shared with a potential employer only if and after we obtain your consent.

If and when a potential employer confirms his/her interest in your application, a first meeting with the potential employer will be organised either using Skype or a face-to-face meeting at SmartestHR’s or potential employer’s premises.

SmartestHR is committed to keeping you informed of any developments during the recruitment process.

After every contact you have with a potential employer, SmartestHR will confirm you are genuinely interested in the post and ask you to bring out points you feel may need to be clarified.

Subsequently, if you join the organization to which you have been introduced through the SmartestHR platform, we will maintain contact with you as well as your new employer during the first few months to ensure that you settle in satisfactorily


2. Intellectual property rights

SmartestHR grants you a nonexclusive, non-transferable, limited right to access and use the content of the SmartestHR platform for personal, non-commercial purposes, provided that you comply with these Terms of Use.

You acknowledge that the SmartestHR platform, software, documents, photographs, images, texts, and other content available on the SmartestHR platform (“Content”) are protected by intellectual property rights and / or other property rights. All brans and logos that you see depicted on the SmartestHR platform are owned by the SmartestHR or their respective owners.

You do not have permission to modify, translate, edit, alter, arrange, copy, reproduce, republish, sell, sublicense, transfer, for public or commercial purposes, or in any other manner use the SmartestHR platform without the SmartestHR’s express prior written permission.


3. Personal data protection

The personal data collected via the SmartestHR platform is processed in compliance with our Privacy Notice.


4. Limitation of Liability


Under no circumstance shall SmartestHR be held liable for any delay or failure or disruption of thecontent of the SmartestHR platform or loss of personal data resulting directly or indirectly from acts ofGod, forces or causes beyond our reasonable control, including without limitation, internet failures,computer, telecommunications or any other equipment failures, hackers’ attacks, electrical powerfailures, strikes, labour disputes, riots, civil disturbances, shortages of labour or materials, fires, flood,storms, explosions, war, governmental actions, orders of domestic or foreign courts or tribunals ornon-performance of third parties.

To the maximum extent permitted by law, the services provided by the SmartestHR platform areprovided “as is”, “as available” and “with all faults”, and SmartestHR hereby expressly disclaims anyand all warranties, express or implied, including but not limited to, any warranties of condition, quality,durability, performance, accuracy, reliability, or fitness for a particular purpose.

To the maximum extent permitted by law, SmartestHR makes no representations or warranties aboutthe validity, accuracy, correctness, reliability, quality, stability, completeness or currentness of anyinformation provided on or through the SmartestHR platform.

SmartestHR shall not be liable for any special, direct, indirect, punitive, incidental or consequentialdamages or any damages whatsoever (including but not limited to damages for loss of profits orsavings, business interruption, loss of information), whether in contract, negligence, tort, equity orotherwise or any other damages resulting from any of the following:

- the use or the inability to use the SmartestHR platform or services offered by SmartestHR;
- unauthorized access by third parties to data or private information of any user; or

- statements or conduct of any user.

The limitations and exclusions of liability to you under these Terms of Use shall apply to the maximum extent permitted by law and shall apply whether or not SmartestHR has been advised of or should have been aware of the possibility of any such losses arising.



5. Availability

SmartestHR cannot guarantee that the SmartestHR platform will be available at all times, without any disruption.

SmartestHR reserves the right to delete the SmartestHR platform (entirely or partly), irrespective of the reason, time or date.

You undertake to refrain from any action which might impede the proper functioning of the infrastructure of the SmartestHR platform, or that might unreasonably overload the platform



6. Amendments

SmartestHR reserves the right to amend these Terms of Use from time to time. If we make material changes to our Terms of Use, we will notify you of these changes by either contacting you via e-mail or by giving notice through the SmartestHR platform, or by any other legally permissible manner. We advise you to periodically check the terms on the SmartestHR platform


7. Applicable law and jurisdiction

These Terms of Use shall be governed by Slovenian law, excluding any conflicts of law provisions.

All disputes arising out of or relating to the use of the SmartestHR platform shall be subject to exclusive jurisdiction of the competent court in Ljubljana, Slovenia, without prejudice to your right as a consumer to seize another court pursuant to mandatory law. Effective date: 4. 12. 2019
